Terms of Service

1. About TASKTOGO

Det 5 Element ApS ("TASKTOGO", "we", "us", "our"), a company registered in Denmark, operates the TASKTOGO platform at tasktogo.com and the TASKTOGO mobile applications (iOS and Android).

By creating an account or using any part of the service you agree to these Terms of Service. If you do not agree, do not use the service.

2. Eligibility

You must be at least 16 years old to use TASKTOGO. By using the service you confirm that you meet this requirement.

If you are creating an account on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must use a strong, unique password and must not share your credentials with others. If you suspect unauthorised access to your account, notify us immediately at support@tasktogo.com.

4. Acceptable Use

You agree to use TASKTOGO only for lawful purposes and in a manner that does not infringe the rights of others or restrict anyone else's use of the service.

5. Prohibited Conduct

You must not:

• Upload, transmit, or share content that is unlawful, defamatory, obscene, or infringes any third-party rights.

• Attempt to gain unauthorised access to other accounts, servers, or computer systems.

• Reverse engineer, decompile, or disassemble any part of the service.

• Send unsolicited commercial messages or spam.

• Use automated tools to scrape, index, or excessively load the service without our written permission.

• Resell access to the service without our prior written consent.

6. Your Content

You retain ownership of all content you create, upload, or share on TASKTOGO (tasks, messages, files, calendar entries, etc.).

By submitting content you grant Det 5 Element ApS a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display that content solely for the purpose of providing the service to you and your team members.

You are solely responsible for the content you submit and warrant that you have all necessary rights to grant this licence.

7. TASKTOGO's Intellectual Property

All software, designs, trademarks, and other intellectual property comprising the TASKTOGO platform are owned by or licensed to Det 5 Element ApS. Nothing in these Terms grants you any right in that intellectual property beyond what is necessary to use the service.

8. Service Availability

We aim to keep TASKTOGO available 24 hours a day, 7 days a week. We do not guarantee uninterrupted or error-free service.

We may perform maintenance, updates, or make changes to features; where reasonably practicable, we will provide advance notice. Our service level commitment is described at tasktogo.com/sla.

9. Subscription Plans and Payments

Paid plans are billed in advance on a monthly or annual basis. All prices are shown in EUR and include applicable VAT.

Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.

Refunds are not provided for partial billing periods or unused time remaining in a subscription, except where required by applicable consumer protection law.

10. Termination by You

You may delete your account at any time from your account settings. After deletion, your account enters a 30-day grace period during which you may request reactivation.

After the grace period, your account and all associated content is permanently and irreversibly deleted.

11. Termination by Us

We may suspend or permanently terminate your account if you materially breach these Terms, if your account has been inactive for 24 or more consecutive months, or if required to do so by law or court order.

Except where the termination is due to your harmful conduct or a legal requirement, we will provide reasonable advance notice before terminating your account.

12. Your Data After Termination

Following account deletion, you have 30 days to request an export of your data by contacting support@tasktogo.com.

After 30 days, all personal data associated with your account is permanently deleted from our systems, subject to legal retention obligations described in our Privacy Policy.

13. Disclaimer of Warranties

TASKTOGO is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be error-free, secure, or continuously available.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Det 5 Element ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total aggregate liability for any claim arising out of or related to these Terms or the service shall not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim, or (b) EUR 100.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

15. Indemnification

You agree to indemnify and hold harmless Det 5 Element ApS and its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service in violation of these Terms or applicable law.

16. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or third-party infrastructure failures.

17. Changes to These Terms

We may update these Terms from time to time. For material changes — such as changes to payment terms, limitations of liability, or prohibited conduct — we will notify you by email or in-app notice at least 14 days before they take effect.

The current version of these Terms is always available at tasktogo.com/terms. Continued use of the service after the effective date constitutes your acceptance of the updated Terms.

18. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.

We encourage you to contact us first at legal@tasktogo.com to resolve any dispute informally. If a dispute cannot be resolved amicably within 30 days, it shall be subject to the exclusive jurisdiction of the courts of Denmark.
